Christiano Fragoso, a partner at Fragoso Advogados, served as a panelist for “Panel 2 – New Perspectives on Criminal Law in Light of Current Supreme Court (STF) Case Law” at the Law Congress organized by the OAB/RJ’s School of Legal Practice (ESA) on April 25, 2024.
The lawyer highlighted the relevance of philosophy to the understanding and application of criminal law, as well as to grasping the foundations of the power to punish and rehabilitate the convicted. He emphasizes that philosophy helps define fundamental concepts—such as that of protected legal interests—which are essential to the legitimacy of penal norms. In his view, many criminal law scholars underestimate the importance of philosophy, even though it is crucial for understanding issues such as the purpose of punishment and criminal liability.
