Christiano Fragoso, a partner at Fragoso Advogados, served as a panelist for “Panel 2 – New Perspectives on Criminal Law in Light of Current Supreme Court (STF) Case Law” at the Law Congress organized by the OAB/RJ’s School of Legal Practice (ESA) on April 25, 2024.
The lawyer highlighted new perspectives in criminal law in light of the Supreme Federal Court’s (STF) case law. He addressed the trend toward the expansion of criminal law, the relaxation of formal rules, the influence of ethics and subjectivity on the application of the law, and the social functionalization of criminal law. He also criticized the Supreme Court for failing to curb this expansion and advocated for lawyers to act strategically to uphold the boundaries of the democratic rule of law.
