Attorney Rodrigo Falk Fragoso launched the second edition of the book “Gestão Temerária de Instituição Financeira” [Reckless Management of Financial Institutions] on Tuesday evening (23) in São Paulo. Published by Revista dos Tribunais and originating from his doctoral thesis defended at the University of São Paulo (USP), the work examines the criteria for criminal liability of financial system administrators. During the book launch at Livraria Martins Fontes on Avenida Paulista, the author emphasized the need for objective parameters for the application of Criminal Law in financial crisis scenarios.
In commenting on the purpose of the work, Fragoso stated that “every financial crisis produces its cycle: scandal, commotion, and conviction.” According to him, the book seeks to contribute to decisions grounded in concrete elements, without severing the link between the criminal sphere and the administrative infractions that regulate financial activity.
“What is missing is criterion. There are judges who resist: who do not punish without concrete damage, without a serious violation of the duty to protect assets, without grounding in administrative misconduct. The book was written for them. And to equip the rest,” stated the author.
The publication analyzes the crime of reckless management of a financial institution, a topic that recurs frequently in discussions on economic regulation and corporate executive liability. The new edition updates the research originally presented in the author’s doctoral dissertation and revisits issues concerning the boundaries of criminal law intervention in business and financial activities.
According to the publisher, the work has already been cited in decisions by the Federal Regional Courts of the 2nd and 3rd Regions. The book is part of the legal catalog of Revista dos Tribunais, a publisher specializing in works for the legal field.
The launch took place during a group event organized by the publisher, bringing together ten other authors.
