This book, in honor of Professors Vera Malaguti and Nilo Batista, is a collection of reflective and critical writings on the penal system, criminology, criminal law, and criminal procedural law, authored by Brazilian and foreign professors—including some of the most prominent figures in the criminal sciences today. Christiano Fragoso’s article, titled “Criminal Code and Criminal Code: Contributions and Notes on the 1936 Nazi Penal Code,” outlines the fundamental features of the 1936 Nazi Penal Code draft, highlighting the strong influence of Nazi ideology on the creation of new criminal offenses and the reformulation of criminal law concepts. The article by Rodrigo Falk Fragoso, titled “Should Criminal Law Punish Capital Market Manipulation?”, presents a critical analysis of the legal interest protected and the constituent elements of the crime defined in Article 27-C of Law No. 6,385 of December 7, 1976.
